Key laws and policies
The Constitution of the Republic of Macedonia stipulates that it is a human right to decide freely on the procreation of children (Article 41).
New reproductive technologies in Republic of Macedonia have been regulated by the Law on Biomedical Assisted Fertilization since 2008. (See Official Gazette of the Republic of Macedonia No. 37/08.)
Permitted and regulated practices
Assisted Reproduction
- The Macedonian law gives priority to using personal reproductive cells.
- Married or cohabiting heterosexual couples or single women may access services, subject to consent.
- Posthumous use of gametes is permitted one year after death.
- Embryo donation may take place if a man and woman have excess embryos from treatment.
History
In September 2014, draft laws were proposed by Health Minister Nikola Todorov to permit altruistic surrogacy, to "ensure that women may only carry a child on behalf of others for humane and altruistic reasons."
